No. Those referred for prosecution will be prosecuted. CBP is in charge of referring people to prosecution. They will no long refer them if they are families with children. Therefore the “zero-tolerance” policy remains with the DOJ, but those families with children will not be referred to the jurisdiction of the DOJ and therefore won’t be criminally prosecuted.
