It was evidence the defense had from their own expert. If they didn’t present it that’s on them. No way this can be bought into appeal because of the ramifications it would have for every single case that ever gets heard.

If your relying on genpop to take care of it the answer is simple. Don’t get rid of the death penalty, get rid of death row. House them in genpop

I hope Melissa Lucio’s death sentence is vacated. I’m wondering if she should have been charged with anything at all.

I can see POSSIBLY charging Melissa Lucio with neglect if she knew Mariah had a clotting disorder & didn’t immediately seek assistance for her after she fell outside their former apartment.

To the best of my knowledge that hasn’t gotten anyone death. It really says something when at least half of the jurors would have made a different decision if they had the full information.

The bottom line for me is the fact that Melissa Lucio’s actual guilt is NOT certain.

Tsarnaev’s guilt is certain.

Dylan Roof’s guilt is certain.

Many other death row prisoner’s guilt is certain.

My line in the sand is certainty. I cannot condone the death penalty without certainty. Certainty simply is not possible in this case.

I would happily participate in the executions of Tsarnaev, Roof and others whose guilt is certain.

But I cannot ever condone an execution where it is not.

Can’t say I disagree. Honestly though, our government is so incompetent that I question the death penalty. While I do agree that death is warranted in some cases, I just wonder why we trust the same people that run the DMV to execute citizens. :smiley:

Exactly…yet some on here, who are the most untrusting of our government because it’s corrupt, incompetent etc are the most in favor of it and trust the courts/ government to get it right…funny how that works.
