In our community sidewalks to the curb are HOA property, not the individual owners (altough we are responsible for appearence and maintenance). Sidewalks are considered a public easeway even if “owned” by the HOA or property owner.

Still doesn’t change the fact that the protesters did not break into the McCloskey’s house (breach the barricade) or present a clear and present danger to either McCloskey. Very different then the rioters breaking through a barricade attempting to get at members of Congress to stop a Constitutionally mandated function of Congress.

I like though that the rest of it having to do with a riot busting through a police barricade in an attempt to reach Congress persons performing their Constitutionally mandated function of counting the Electoral College results and were in fact a clear and present danger.

As I said before, make the conditions similar and the McClosky’s could have blasted away. But - shurg - there was not riot breaking through police barricade present a clear and present danger from the sidewalk and on the road which prompted the McClosky’s to exit the house and point firearms.

The gate was at the entrance to the community. Hence the name “Gated Community.” Its ALL private property. Each homeowner owns to the curb which includes the sidewalk, the common spaces, such as the streets, are commonly owned by the association.

It was not murder. The number 1 job for Capitol Police is the protection of Congress and half of Congress was down the hall. If that hallway/door was in the White House and those were BLM supporters last summer I guarantee the same or worse situation would of happened at the hands of Secret Service

I’ve been talking about a rioter that broke through a law enforcement barricade who presented a clear and present danger to members of Congress and their staff as they were being evacuated 10s of feet away from the rioters attempting to prevent the from performing their constitutionally mandated duty.

This occurred on January 6th so it is very on topic. I didn’t introduce the McClousky’s to the discussion.

#1 The gate wasn’t on McClowsky’s property. It was a gate owned by the community which I’ll refer to as a Home Owners association.

#2 The McClowsky’s exited their home and branished firearms to confront the protesters which presented no clear and present danger to them or to others, the protesters did not break into their house or endanger them.

#3 The rioters in DC on January 6th broke through a law enforcement barricade where there was an armed officer and presented a clear and present danger to congress members and their staff that were only 10s of feet away and were in the process of being evacuated.

Very different situations. Am I sad that Ashley Babbitt was shot? Absolutely. Was the shooting justified because of clear and present danger for the congressmen and their staffs attempting to fulfill a Constitutionally mandated event (the counting of the EC votes)? Yes. I wish it weren’t, but yes it was a justifiable shoot (IMHO).

There were Congress members on the other side of the door. The job of Capitol Police is to protect them. If that was the White House and there were cabinet members down the hall I have no doubt thR Secret Service would of done the same thing.

No not ATTEMPTED to pass through. The window was broken out and she had climbed into the window space and WAS ACTIVELY passing through the law enforcement barrier. Now she didn’t succeed because she got herself shot, so you/we can quibble about “attempted”. Sure she “attempted” but got shot in the process of actively climbing through.
