While I hope he takes FOX for all he can get, I don’t generally have that much pity for him - it’s very much a lie down with dogs situation.

Anyone can file a lawsuit. It means nothing by itself.
In the case of anything with political implications involving the FBI/DOJ etc., I would not be surprised if the lawsuit is part of a state-supported lawfare effort. The message from the DOJ would be settle with Epps or else face prosecution. Here is one example statute:

Other possibilities would be to prosecute Fox News journalists and commentators as unregistered foreign agents, a new favorite tool in subverting the Bill of Rights. The idea is to follow the Putin playbook in eliminating dissent:

The FBI has conducted similar campaigns in the past. Here is a description of revelations from the Church Committee about FBI activities during the Vietnam War:
Infiltration: Agents and informers did not merely spy on political activists. Their main purpose was to discredit, disrupt and negatively redirect action. Their very presence served to undermine trust and scare off potential supporters. The FBI and police exploited this fear to smear genuine activists as agents. . .

Yes. On the other hand, the murder-by-fire-extinguisher hoax was used to create the false narrative about a “deadly insurrection” that has resulted in mass arrests and defendants being sent to prison for years without trial.
Officer Sicknick died of natural causes, a stroke. Even a quick inspection of his body should have been sufficient to show that there was no evidence of injuries associated with a deadly beating with a fire extinguisher.
The hoax was created and supported by federal officials and their friends in the media. The cremated remains of Officer Sicknick were laid in state in the Capitol, and the hoax was cited as evidence by the prosecution in the second impeachment trial.
No one has lost their job. No one has faced prosecution for their role in creating and perpetuating the hoax.

Pretty difficult to be defamed by videos of calling for Capitol trespass and then not being prosecuted like literally everyone else.
