‘Empire’ actor Jussie Smollett missed Thursday’s deadline to reimburse the city of Chicago for their “investigation” costs associated with his alleged hate crime hoax, with officials now confirming they plan to sue the celebrity to recoup upwards of $130,000.

“Mr. Smollett has refused to reimburse the City of Chicago for the cost of police overtime spent investigating his false police report on January 29, 2019,” said a spokesperson Thursday. “The Law Department is now drafting a civil complaint that will be filed in the Circuit Court of Cook County. Once it is filed, the Law Department will send a courtesy copy of the complaint to Mr. Smollett’s L.A. based legal team.”

Smollett’s legal team fired-back at Chicago officials hours after missing the seven-day deadline set by outgoing Mayor Rahm Emanuel.

“As you know, Mr. Smollett vehemently denies making any false statements to the City of Chicago… Thus, your claim that Mr. Smollett filed a false police report and orchestrated his own attack is false and defamatory,” read the statement.
