Not going well so far… Dearie isn’t putting up with any nonsense from the Trump camp.
Tuesday’s hearing came a day after Dearie circulated a draft plan to both sides on Monday which sought details on documents Trump allegedly declassified.
In a letter filed ahead of Tuesday’s hearing, Trump’s lawyers argued it was not time to address Dearie’s questions, and it would force them to disclose a defense to any subsequent indictment - an acknowledgement that the investigation could lead to criminal charges.
On Tuesday, Trusty told Dearie that he believes Dearie’s request to provide a declassification defense goes beyond the scope of what Cannon asked him to do.
Dearie said he was “taken aback” by that claim.
“I think I’m doing what I’m told,” Dearie said.

Dearie is taking the position that, unless Trump’s lawyer want to make a claim to the contrary, if the government says the documents are classified, they are classified. So far Trump’s lawyers are not making any claim that Trump declassified them.
I don’t think they will make that claim either. They are between a rock and a rock. If they say they are declassified, that would make them available via FOIA request. Not a good look for team crime either way.

I really am interested to see how Trump and his legal team will spin it. I assume based on Trumps previous history he will set out to bully and ridicule the Special Master and then his disciples will start chanting deep state and talk about how Trump was badly advised (again). Maybe even turn on the legal team.

Sheesh- where did Trump think this would go. That the special master would say that Trump has a right to have these documents back? Come on man. This was a stall tactic that is stalling out…fast.
They won’t make that claim, as it would essentially be admitting to multiple crimes, and offers nothing in defense.
Everyone keeps forgetting that classification doesn’t really matter under the Espionage Act.
