That’s quite a thing to get wrong, to claim that the president was somehow lying and that the fbi was not in possession of items they reportedly were not allowed to take without a separate warrant.

The secret, unrecorded unilateral declassification of a hodgepodge of documents/files, unknown to any other agencies involved (and regarding material largely unknown to Trump himself; no way he carefully vetted all or any of it) is pretty funny.

There’s no record of it. So if someone filed a FOIA act for any of it, how would that work? It would be impossible. Do other agencies and departments who have a stake in the documents know? And any nuclear stuff is protected by the Atomic Energy Act, and the president cannot declassify it.

BTW: As I understand it, none of the possible charges on the warrant actually depend on this question. I think the DOJ and FBI anticipated this claim.

So then it isn’t actually declassified. To declassify something REQUIRES remarking. If the document is not remarked then it is considered classified at the current level.

Is “since he went through a formal process to,declassify operation hurricane documents, we may surmise that not going through that process means….” really the basis for charging a former President and current opponent with a crime?

I personally don’t think that he should be charged… barring some new information that he was allowing for people to have access to these records or something like that… but the idea that he can secretly declassify stuff and tell everyone that he did so after he has left office is extremely stupid.

You did. You where shown to be wrong.

It may have removed intent during the prior to the initial contract by the NARA in Feburary 2021, however it actually PROVES intent to retain government propert after being informed that he was in possession of government property and classified documents and then refused to return them.

Intent is shown by 18-months of negotiations, a grand jury subpoena not being complied with, and finally only getting the all the documents back by execution of a search warrant and the government confiscating it’s property.

Mistake made in the chaos of Janaury 2021? Sure. Return the documents no harm no foul.

20-months of illegally keeping property after notification? Proves intent.

How would a defense contractor know that Trump declassified something if not by a memorandum or letter?
