If the law states that Congress can pull anyones IRS documents for the purpose of embarrassing them, then that law is not valid under the Constitution. Congress is given the power of oversight, not the power of embarrassing people for political purposes.

Imagine if congress allowed tax information to be published in newspapers… Would that be a 4th amendment violation?

He’s not talking 4th amendment. Here he’s talking about Article I of the Constitution and the limitations of the authority of Congress. Its not just a too strong executive that can be tyrannical.

He is making the argument that the request is a pretext to making the tax information public. Could congress pass a law making all presidents and vp’s tax information public record? Would that be unconstitutional?
