When a company acts on behalf of the government it is subject to the same rules the government is. Yes people have sued but that was before we had the receipts, there is also a current case involving Alabama and Missouri who will have those receipts, so lets see how that case goes shall we?

Please point to the court document where the FPOTUS has claimed to have declassified the material.
As a matter of fact when question by Judge Dearie on the issue them specifically REFUSED to make the claim that the documents were declassified.

I was speaking in terms of why anyone should care, not about legalities there.
It matters because unless he (a) makes the claim in court, and (b) presents evidence that he declassified them prior to noon on January 20, 2021 - then there is no difference between him stealing classified materials when leaving office and me stealing classified materials when I retired.
With no claim and evidence to support the claim, than as Judge Dearie said in his response - the classification remains in tact in accordance with the classification markings.

That’s because - in the cases of Reagan and Trump’s disclosures to the Russians - the information wasn’t declassified.
