He was already impeached when he was POTUS.
Now the pending charges are when he is a private citizen.
So why do you think that he should not be charged if he broke the law now?

No, he won’t. Because an accused in the justice system gets disclosure and to call their own witnesses and to cross-examine the prosecution’s witnesses. And the Democrats don’t want that.

The will stick to their shoddily designed injustice system of trial via story-telling.

Tried in the media for years, Mueller investigation with multiple lawyers and given a wide scope by the DoJ, impeachment 1, impeachment 2, J6 commission…almost every news channel, almost every moment of every day, it goes on and on and on…orange man baaa, baaa, baaad. The democrats wanted McConnell to make an independent commission with equal number of appointees.

McConnell refused.

Then they invited McCarthy to seat 5 or 6 members. He put up two election deniers, pelosi said no to them, yes to the others, and invited him to replace the two.

He refused and pulled them all.

It’s clear he raised the crowd on J 6 to stop the counting of the electoral votes in an effort to remain in power.
