Their primary path (IMHO) will be to attack the evidence and try to get it thrown out. Either by the search warrant being defective or individually piece by piece. If they can get the documents thrown own, then there are no remaining charges for the conspiracy and obstruction charges.

So technicalities.

Although in thinking about it the conspiracy and obstruction, as it relates to failure to comply with the subpoena, might be able to proceed independent of the actual documents.

The prosecution is ready to try the case at this point. They are prepared for a speedy trial. Trumps lawyers though are going to waive a speed trial - and you can take that to the bank - attempting to push the proceedings into the general election cycle or even better past the general election.

Yeah this is what I was assuming- trying to get evidence removed as inadmissible due to technicalities and leaning on the judge, and then delaying. Eventually the main work will be getting a good jury pool.

But as to an actual rational defense for the substance of the matter? I just don’t see it.

Anyone can “legally contest” anything they want. But in this case, (1) Trump didn’t; and (2) if he had, he’d have lost.

There has been no claim in court that the FPOTUS declassified anything and when asked last fall at part of the initial document proceedings last fall that was a specific question asked by Judge Dearie to Trumps legal team. The refused to answer.

Does refusing to answer legally prove one way or the other?

At a minimum, he’d have to officially order it declassified.

Below is an example of what that declassification process and order would look like. This is a published memorandum from the day before Trump left office in an attempt to declassify documents related to Crossfire Hurricane.
You might notice that Trump didn’t just wave his magic wand and declassify everything. He negotiated with the FBI and others to redact certain portions.

We are at war right now … in Ukraine. The only difference is, Americans aren’t dying there … yet.

Nonsense, not a single US soldier is in Ukraine. Nor will they probably ever be. And every bullet we send there is fired at a Russian soldier, money well spent. Think of all the money we spent on the Cold War, and none of it took a single one of them out. Now, we are getting some return on our investment. Risk free.

Did you miss the word “yet”? What will the US do if Russia crosses the line and engages a NATO member or escalates to deploy nuclear or chemical weapons?

We are at war in every respect other than by deploying troops into the combat arena. And ten will get you twenty that we have military personnel on the ground in Ukraine at this moment and have since days after the Russians invaded.

Again- there is no way to prove Biden or Pence knew they had taken those files and that it wasn’t inadvertent. There is definite proof that Trump knew he had files he should not have.
