If the impacted active duty members filed formal complaints, then it would probably be possible to recall him to active duty and then charge him under the UCMJ. Probably send him to Captains Mast instead of a Court Martial.

Dereliction of duty, conduct unbecoming, defamation/libel, endangering life and property - I could probably come up with half a dozen charges that fall under Article 134 and I’m not even a JAG.

Remember our conversation a few months ago about the different between being on the retired list and Fleet Reserve? E-7 Gallagher transferred to the Fleet Reserve after 20 and won’t “retire” for another 10 years. He’s still subject to the UCMJ.

I would appreciate your opinion on my post just before yours.

#1 Is E-7 Gallegahar still subject to the UCMJ especially since he’s not retired (although that is language commonly used in the media) and is actually still part of the Navy’s Fleet Reserve component not moving to the retired list until he’s completed a total of 30 -years.

#2 That his actions are chargeable under various articles - I’m thinking Art 134 most likely - and that he could be exposed to non-judicial punishment under Article 15. He would still have the option of not accepting Article 15 and request a court martial which can be very dangerous to him as the level of punishments go up.

No need to lock them in. A simple promise not to prosecute should do it.

Nothing to sere folks. Just Trump wanting to signal to military personnel that he has the back of any military members who might disobey orders and the military code of conduct if he needs them in the future to back his criminal actions.

Obviously you do not know much about the military, or about Trump.

The Dept. of Defense is the largest government department there is, and it is just as full of bureaucratic imbeciles and political hacks as any other department.

Officer above the grade of colonel are essentially politicians. This has been a known fact forever. While we admire and praise the bravery of fighting soldiers in the field, we despise political hacks in the Pentagon.

Bottom line, the Pentagon advice was crap and Trump did the right thing. The fighting men and women who lay their lives on the line know that their Commander in Chief has their back. And you charge, that Trump signaled to military personnel that he has the back of any military members who might disobey orders is just disgusting.

I agree.

The military can call him back to active duty and prosecute him. The Retired Reserve is no different from the inactive Ready Reserve or from service in a Reserve unit. He remains subject to the UCMJ and can be freely called back to active duty for violation of the UCMJ.

I would recommend that the Navy do any investigation quietly and if they find grounds to prosecute, perhaps wait until Trump is out of office. Gallagher will be under UCMJ jurisdiction for close to another decade there is no pending statute of limitations that they have to race.

No sense prosecuting him until such time as Trump can no longer pardon him.

I have zero confidence in the Democratic Party not to **** this election up just as they did in 2016. Particular if they go way left like Warren or Sanders.
