I would appreciate your opinion on my post just before yours.
#1 Is E-7 Gallegahar still subject to the UCMJ especially since he’s not retired (although that is language commonly used in the media) and is actually still part of the Navy’s Fleet Reserve component not moving to the retired list until he’s completed a total of 30 -years.
#2 That his actions are chargeable under various articles - I’m thinking Art 134 most likely - and that he could be exposed to non-judicial punishment under Article 15. He would still have the option of not accepting Article 15 and request a court martial which can be very dangerous to him as the level of punishments go up.
