If the impacted active duty members filed formal complaints, then it would probably be possible to recall him to active duty and then charge him under the UCMJ. Probably send him to Captains Mast instead of a Court Martial.

Dereliction of duty, conduct unbecoming, defamation/libel, endangering life and property - I could probably come up with half a dozen charges that fall under Article 134 and I’m not even a JAG.

Remember our conversation a few months ago about the different between being on the retired list and Fleet Reserve? E-7 Gallagher transferred to the Fleet Reserve after 20 and won’t “retire” for another 10 years. He’s still subject to the UCMJ.
