Trying to separate their physical imprisonment from the many steps the US government took to get them there is a ridiculous argument that will never fly in court.

What court do you speak of?

Putting these people in CECOT without a trial was a process, a series of steps, and focusing only on the final step doesn’t let the government off the hook.

They weren’t deported. They were detained… chained and put in prison.

They were detained. Given due process. Chained and deported to ES.

If we were simply deporting… they would board a plane without chains.

It depends on the circumstance. Some might simply get a bus ride across the border. Every situation will be different.

If he wants more immigrant workers in those industries, he should propose something like special visas. And try an actual law instead of “prosecutorial discretion” like Obama used.
If you want them here, try a legal route and not continue the practice of selective enforcement.

In agriculture they already exist. (H2a and H2-b visas)

It’s like nobody in government actually know that the LEGAL means to come to the US ALREADY exists for both agricultural (H2A) and non-agricultural (H2B) workers.

Your “salient points” are a garbage arument. The violation occurred BEFORE the immigrants left US soil. The moment Trump inc signed an agreement to send immigrants to prison they violated the 5th and 14th amendments.
