Trump administration moves to ban bump stocks


The Trump administration Tuesday banned bump stocks, the firearm attachments that allow semi-automatic weapons to fire like machine guns and were used during the worst mass shooting in modern U.S. history.

The regulation gives gun owners until late March to turn in or destroy the devices. After that, it will be illegal to possess them under the same federal laws that prohibit machine guns.

Wow. Will the NRA somehow throw a bone in this?

Ladies and gentlemen, Dumpster Donnie has accomplished what Obama couldn’t - he is moving to get the government to confiscate gun paraphernalia with “conservative” approval.

I’m not sure of anything with the NRA anymore. I’m a member now, but won’t be renewing with some of the recent news that has come out.

8 years of yelling and screaming and kicking by the NRA and gun nuts that Obama was going to take their guns and destroy them, 8 years of kids getting shot with nay but “thought and a prayer” , 8 years of “its not the time to discuss it”

Why should they? Nobody knows they have them.

They are not being banned, they are being classified as class III weapons … like suppressors. I expect people who have them will be given a period (3-6 months or so) to submit the required paperwork to the ATF to register them. After that “grace period” they would be illegal to possess.

By the way, that is what the NRA advocated following the Las Vegas shooting. The big issue here is that it is being done administratively rather than legislatively. The ATF is, in effect, changing their minds on a previous determination that was made by strict reading of the statutes without any change to the statute by Congress. That is a dangerous precedent.

It is impossible to know just how many bump stocks Americans own because the devices aren’t traceable, but ATF has estimated that between 280,000 and about 520,000 have been sold since 2010.”

That part of the order is illegal. Only Congress can require that by changing the law. The key words are “prohibit machine guns.” Machine guns are not illegal under the law. They are classified as class III weapons which require they be registered to the owner and a one-time tax paid on them. Bump stocks now fall into the same classification. If Trump wants them turned in and destroyed, he must get Congress to pass a law to do that.

Undoubtedly, this illegal order will be challenged, and if the Court abides by the Constitution that “turn in or destroy” order will be suspended.
