An enemy, for purposes of the treason clause, is defined as only “subjects of a foreign power in a state of open hostility” towards the U.S. Finally, the crime of treason by aiding an enemy can only be committed during a time of war.
That’s a valid question. Was the Soviet Union our enemy during the cold war? There was no shooting war, and in fact, they were our allies for a time while defeating Nazi Germany, but the level of adversarialism was so intense I think it safe to say we considered them an enemy. The Rosenburgs were executed for treason passing secrets to them.
No they weren’t. They were executed for espionage.
Similarly, that is why the Rosenbergs could not be charged with treason because, at the time, the United States was not at war with the Soviet Union. Espionage provisions typically are the gap-fillers for activities that appear treasonous when the U.S. is not at war.

You are correct. I was genuinely curious if there were exceptions and I could find none. It can only happen during wartime.

The current crop of socialist Democrat lawmakers along with the MSM are indeed enemies of the country. They are blatantly and shamelessly “in our face” 24/7 with their seditious rantings!
