Because that’s not what “premeditation” means.

Good point.

Well if that were you true… you would accept manslaughter because that is “what is”. “What if” is murder.

You feel she made a mistake?

The facts in this case show malicious intent, the intent to harm that resulted in death.

The only one inconvenienced by this are the victim, friends and family of the victim and the family and friends of the murderer.

I can think “what if” all day long. Does that make me a murder?

Causing death yes.

I think the act itself wasn’t a mistake. I think it was entitlement.

What do you feel she hoped to cause?

passage without hindrance. For that she def deserves jail time

You’re using a lot of words that don’t mean what you think they do - at least in a legal sense.

The intent behind her act of shoving Ms. Gustern is undeniable. But, with the information we have now, it is unlikely that this woman expected or intended that Ms. Gustern would die as a result of that shove.

Of course you do. What exactly do you base that opinion on? Did the red hair trigger you?

Is that the excuse now? I just didn’t expect shoving an 87 year elderly person might cause them to die?

Nope.

I base it on general rudeness that permeates major population centers.

The black guy who smeared feces on a NYC transit rider was also acting in part out of entitlement. There are many other reasons too. Don’t assume.

Ahh, rudeness. Well, there you go.

What do you think is going to happen to these thugs? 500k cash bail?

It’s not an excuse, we’re talking about what happened.

I think you’d agree that the context of a killing matters.

Yeah. Death.

Context matters.

The way bail reform was done was terrible. While i agree with the premise. The implementation speaks volumes about an over reach by the woke left.

Do you think a man who kills the rapist of his daughter is equally culpable as a man who kills his business partner for money?

Yes, context matters. It’s written into our laws.

Mmmmm. If you are correct, I will agree.

I’m not debating generics. Stick to this case and stop with the “but, but, but, what if’s”.
