There is no mechanism in the United States for the courts to audit the vote. Any spoiled ballots are already not part of the count.

Representatives present in the Democrat run states still counting are reporting the approval by Democrat sorters of ballots Republicans think should be discarded. The courts will ultimately arbitrate on who is right in those cases. Also, there are reports of Republican observers being shut out of some facilities sorting votes.

The courts will be ultimately determining whether vote sorting and vote tallying was done by the book.
