The Plaintiff put a sign on her lawn reading ■■■■ em both 2024. Local code enforcement ruled the sign obscene and began enforcing fines against her. She persisted and went to Federal Court.
The court ruled the sign ordinance unconstitutional and awarded the Plaintiff all fines paid to the city and her $31,000 in attorney’s fees and court costs.
It shouldn’t require all this effort by a Plaintiff to overturn an ordinance which is so obviously unconstitutional. It should be easier to get a summary judgement when the outcome is so clearly obvious.
