We now have the busiest district court in the United States here in eastern Oklahoma. It is true that thousands of cases have been affected by this ruling. The eastern tribes here do not have felony courts to prosecute crimes that fall under the McGirt ruling or that are committed now, so the federal government prosecutes them on the tribes behalf. This has created a huge backlog of cases that are being plea bargained out to ease the jam. Rapists and murderers getting probation , time served, 5 years. It seems it is a criminals market here in Oklahoma.
As we speak people charged by the state for felonies are requesting time for genealogy testing in hopes that they can find out that they are Native American and can end up being charged federally instead.

As a victim of a crime, let me tell you, this is a double edged sword. The repercussions of this decision may make a murderer serve a minimal sentence because there was nothing in place to handle the consequences of this decision.
