The same sex couple would have to have “tangible” harm to challenge the law. The couple didn’t challenge the validity of the law. They reported the violation of the law to the appropriate authority who then took action.

Mr. Phillips challenged the law, however the SCOTUS didn’t decide if the baker gets special rights to ignore the law, they reversed the lower court because of how the Commission processed the case exibiting an undue bias which tainted the concept of equal treatment.

There is nothing unconstitutional about generally applicable laws regulating commerce.

BTW - This wasn’t a federal law, it was a State law, which under the 10th Amendment, allows States to regulate intrastate commerce.

Read the Constitution some time, the 13th Amendment reads “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.”

Prior to the 13th Amendment some state had slavery, some didn’t. It wasn’t “OK” by our standards but it was legal.
