The Supreme Court has overruled the judgement of the Special Master in the case of Florida v Georgia. The Special Master had ruled that Florida had not met its burden of evidence and had ruled to dismiss the case. The case will instead move forward and the Special Master will be required to proceed under a less stringent standard. While this in no way means that Florida ultimately will prevail against Georgia, it basically means they are alive to fight another day.
Interestingly, this was a 5 to 4 split and NOT along the usual lines.
Justice Breyer wrote for the court, joined by Justices Roberts, Kennedy, Ginsburg and Sotomayor.
Justice Thomas dissented, joined by Justices Alito, Kagan and Gorsuch.
The dissenters would have upheld the report of the Special Master in full and would have dismissed the case.
