No i know she is not for prosecutors or defense attorney recommendations or probation department recommendation but i really thought she was bound by the 5 year min. I’ll read up on it more.

I would note that as a result of United States v Booker (with both Scalia and Thomas in the majority) the Supreme Court ruled that the Sentencing Guidelines are discretionary, not mandatory. While a Judge still must start from the guidelines, he has full discretion to depart high or low from those guidelines, but must explain why.
