Try What again. Thatâs mandatory minimum not sentencing guidelines.
I said mandatory minimums which she followed. You then post a mandatory minimum not a sentencing guideline.
For not less than 5 years is a mandatory minimum not a sentencing guidelines.
Ok then she didnât follow the mandatory minimum, not the sentencing guidelines which are different but the prosecutors didnât recommend the mandatory minimum either so i am clearly missing something with regards to mandatory minimums as well. Lol.
hereâs another hint, not (a)2
He wasnât being sentenced under 5.
sheâs not bound by the prosecutors reccomendations, and according to her testimony she follows whats written in the law.
obviously, not

No i know she is not for prosecutors or defense attorney recommendations or probation department recommendation but i really thought she was bound by the 5 year min. Iâll read up on it more.
Well i am on a roll lol.
Then the mandatory min didnât apply.
This is making more sense
Thank you!

Simple possession doesnât have a mandatory minimum.
âPossession of child pornography is punishable by up to ten years (or up to 20 years if the offense involved a minor under 12) in federal prison butâunlike the other offenses involving actual child pornographyâdoes not carry a mandatory minimum term of imprisonmentâ

I would note that as a result of United States v Booker (with both Scalia and Thomas in the majority) the Supreme Court ruled that the Sentencing Guidelines are discretionary, not mandatory. While a Judge still must start from the guidelines, he has full discretion to depart high or low from those guidelines, but must explain why.

We donât know the full story.
3 months AND 5 years and 1 month of supervised release with severe restrictions.
Maybe his 17 year old GF sent him picture which he kept. Bad idea.
Heâs a sex offender for the rest of his life.
