OSHA’s COVID–19 Vaccination and Testing; Emergency Temporary Standard, 86 Fed. Reg. 61402, is stayed pending disposition of the applicants’ petitions for review in the United States Court of Appeals for the Sixth Circuit . . .
But it reversed a stay on the DHS vaccination mandate for most health-care workers. In both cases, the rulings appear to be based on statutory authority, not constitutional grounds. My understanding is the ruling are only about the immediate stays, and the cases could come back to the court in the future.
Meanwhile hospitals are allowing COVID-positive workers to continue working as Omicron rips through fully vaccinated workforces. Will Omicron make the vaccine mandate obsolete before they even get through the court challenges?
The rejected liberals said they thought we should be letting unelected health experts rule us.

It’s crazy. It’s as though health experts have our best interests in mind. Are you ■■■■■■■ kidding me? If there’s no pandemic, half of them are out of a job. You think they will say “ALLLLL CLEAR… YOU DONT NEED ME ANYMORE.”
The OSHA mandate was a huge stretch, I doubt it will come back to the court. If the OSHA mandate were brought back, the government could end practically any constitutional right by firing people who do not comply using the pretext of worker safety.
Chief Justice John Roberts, who was appointed by President George W. Bush, said during arguments that he thinks it’s hard to argue that the 1970 law governing OSHA “gives free reign to the agencies to enact such broad regulation.”
Argumentum falsum dilemma. That’s a false dilemma, commonly used by government to rationalize authoritarianism. Same argument used to rationalize 2nd Amendment violations.
That will likely be so far down the road that the healthcare workers will be either vaxxed or fired. Overturning the mandate will not restore those workers to their jobs, because a large number of the healthcare institutions are going to say that they would have imposed the mandate anyway.
From the brief summary I read, the broader mandate was rejected because OSHA is to deal with occupational hazards. Since COVID can be caught in a crowd at a sports event, at a party, meeting friends or many other places it is not a risk specific to an occupation. However, for healthcare workers they consider spreading diseases as part of the occupation.
Makes sense to me.
What happens when people find it difficult to get tested? Our governor has mandated state workers as of Nov. 29th, but it has yet to be enforced. I think they just keep delaying it.
Good question because I don’t think that government really thought that through. And we all got a taste watching or even sitting in lines for hours waiting to get a test.
The vaccine mandate for HC workers is absurd and will only accomplish shortages in clinics and hospitals that the Dems will use to blame the unvaccinated and of course prolong their “emergency” measures tyranny.
Hospitals and clinics will have no choice but to ignore the idiocy of the mandates or there will be no medical care for those that need it and I’m not talking about the virus & its many variants; I’m talking about all the other ailments & injuries that need treatment.
