This is the entire point, in my opinion.

We will never answer the question of personhood in a way that everyone will accept.

But it is the dependency issue that is the sticking point.

It is not necessary to answer it in a way everyone will accept. It just requires enough people with the constitutional authority to accept and codify an answer.

If the baby is a person, and if the constitution means persons by “men”, the foetus’ right to life is protected. If “men” means humans, the foetus is protected. If “men” means neither human nor person, the constitution leaves it to states.
