Yep. They ask you a question, you don’t have to answer if you feel the answer will incriminate you. You simply plead the 5th. Works the same way with any law enforcement.
You can lie to law enforcement as long as it’s not obstruction of justice. Are you arguing obstruction of justice should be legal? You always have the option of saying nothing.
Sure. Plead the 5th, then they just assume you’re guilty because you clearly have something to hide. Brilliant strategy. I’m surprised it doesn’t work more in actual practice with how smart it is.
If you decide to waive your right to be silent, you cannot lie to a police officer. If you lie about your identity or to obstruct an investigation, it is illegal. You cannot lie under oath. If you lie about not knowing how fast you were going, the speed limit in an area, or feign ignorance to local law/ordinance that is not in itself illegal. If you lie about trival matters not directly tied to an investigation, that in itself is not illegal.
I’m shocked by the proposition that obstruction of justice should be legalized.
