Sept. 11 trial judge forbids use of FBI interrogations at Guantánamo

In a substantial victory for Guantanamo Bay defendants, the Military Commission has suppressed statements given by the defendants to the F.B.I. in interrogations before the defendants were permitted to have defense counsel.

I believe this to be the correct decision. The F.B.I. interrogations were conducted right after the defendants were released from C.I.A. black sites and because of the psychological torture dished out by the C.I.A., the defendants could not have made a competent decision to refuse to speak to the F.B.I.

At least this is a step in the right direction. Still, I would prefer these entire proceedings be transferred to the Article III Courts.

There is other evidence available to the prosecution.
