Don’t go into high risk neighborhoods if you can avoid it. There’s a reason they are “High Risk”.

Avoid putting yourself into situations that can quickly end with you being robbed, hurt, or killed and you’ll probably never have to deal with the aftermath.

Manslaughter or even Felony murder depending on the exact details as to why they attempted to stop him to start with weighed against GA law.

There doesn’t appear to be any premeditation on their part but if they were committing a felony by unlawfully attempting to stop him, they could probably apply the felony murder rule depending on GA’s statute.

Either way you end up with basically the same outcome, 2nd Degree or manslaughter.

There’s no evidence to suggest that was their motivation.

following the GA statutes with the false imprisonment its felony murder. if you don’t charge the false imprisonment its felony involuntary manslaughter.

don’t know that they’ll let them plea, max sentence for involuntary manslaughter is only 10 years and the crime being associated with it is “other than a felony”. I haven’t found a lesser crime for false imprisonment in GA.

there is no 2nd degree in GA. there is only one murder statute. it covers all murders and it is a capital offense. minimum sentence is life.

Pretty archaic. Looking at the statutes this should probably be charged as “Felony Murder” or “Voluntary Manslaughter”.

They could argue “Involuntary Manslaughter” as well depending on the established intent from the start.

There’s a lot of leeway under the law depending on circumstances for the Jury/Judge to determine the appropriate punishment.

involuntary manslaughter max of 10 years
voluntary manslaughter 1-20 (this crime does not fit the voluntary statute)

so it seems, they either get life or 10 years.

edta: GA does not appear to have a misdemeanor version of false imprisonment. for the involuntary manslaughter charge the crime being committed must be “other than a felony”. the only charge theses guys might be able to be charged with is murder.

1-20 is a very broad range and the circumstances will dictate the time.

If I were one of these guys I’d be looking for a plea on IM and praying for 1-5.

Depending on the facts that come out that would probably be the best they could hope for.

It all depends on the circumstances that led to the shooting.

Did they have a reasonable belief though errant that what they were doing was legal?

We still really don’t know and that would be key to deciding how to charge it and what they can reasonably expect for penalties.

Still a lot of unknowns here.

IM statute covers that, but they’ll have to find some misdemeanor to charge to apply it. If they go with false imprisonment the only possible charge appears to be murder.

The term homicide applies any and all deaths of a person due to the actions of another person. It doesn’t matter if it was planned and intentional or through negligence, it’s still a homicide.

Ignorance of the law is not a valid excuse. If what they did leading up to the shooting was illegal, it doesn’t matter if they believed it was.
