Further, it was far-left Justice Elena Kagan who wrote the decision. As Kagan explains, in order to apply for legal residency, you must have been admitted to the country lawfully. It’s not really any more complicated than that.

Roughly, the decision was ‘the law doesn’t recognize emergency status granted to people from these dozen or so countries as admission to the US, but because Congress is about to change that status, we’ll just agree with current law’.
