To use an extreme example -

One has the right to believe a black person should die tomorrow because he’s black.

One does not have the right to kill a black person tomorrow because he’s black.

Obviously, denying service is nothing like murder. But the principle is the same.

But FTR, you are right SCOTUS stretched the commerce clause farther than it ever has for PA laws. If you read the opinions, they explain their reasoning as best they can, but will always be a stretch.

By the same token, I have a more practical reason for disliking PA laws. If someone who owns a business is a racist I would like to know about it. That way I don’t give my hard earned money to him or her.

I can see your point. I am still not ready to decriminalize racial discrimination. I am close on agreeing that maybe at the small business level, we can start decriminalizing it.

Also, I am not really THAT worried about decriminalizing PA in California. However the major of my family, and black people in general, live in the south. In my opinion, that area would be problematic.
