Emoluments Clause:
In this type of case it would in fact be the taxpayers because the legal action is a direct outgrowth of Trumpâs official position as President of the United States.
Campaign Finance Law Violations:
In this type of case it wouldnât be the taxpayers paying for the lawyers. It could be the the Trump Campaign that could pays for the lawyers. Those making contributions to reelect the president then are really financing a legal defense team for actions taken by the campaign for the 2016 election. Maybe why Trump maintained a campaign even after assuming office, reactivating it for 2020 almost immediately.
State or Federal Tax Evasion or Fraud Law Violations:
In this type of case it wouldnât be the taxpayers paying for the lawyers. It would be Trump or the Trump Organizations paying for lawyers as a private entity. If it is a private tax matter then the Campaign cannot pay for it and government lawyers could not represent him.
