These kinds of stories are always fascinating to me because it’s clear that this “article” is a glorified press-release provided by the aggrieved parents, and their lawyers, the Alliance Defending Freedom. I mean, just look at the images in this story. Which is all fine, I guess, but there’s clearly very little attempt here to tell the entire story. Which, again, is fine, knowing the media source (FoxNews).
So aside from all that, it seems like one of the main questions here is whether the Jefferson School District should be required to tell parents about the sex of their children’s roommates before district-sponsored trips. And to this, I would actually agree with the Waileses here. I think if a school district has a gender based policy like this, they should be as transparent as possible with parents and students about who they will be sharing an overnight room with. This gives all parties involved time to find an agreed upon solution if there are issues.
If there are issues? What the hell? Don’t over think it. The girl doesn’t want to sleep with a boy. The perverts in charge want to force her to. It’s as simple as that.

That’s all well and good in theory, but that’s not what happened. The Wailes girl confidentially asked to be rebunked because she was uncomfortable with the sleeping arrangements and she was accommodated. So that leaves only the same room, but not the same bed.
That is correct, I think. Assuming the ADF’s version is correct, then the school should have alerted the parents of the possibility of there being trans-gendered students bunked with cis students without naming names, and the whole thing handled confidentially in advance. Easy fix - well publicized policy and the opportunity to opt out.
It is unclear to me (and I don’t have time right now to go hunting for the complaint.) what theory the parents are suing under. Based on the tone of the letters, I have to assume it is some sort of a civil rights complaint. Based on what I know about Colorado law, it kept possibly be under state law, so that means it must be some specie of section 1983 claim. that is sort of my bread and butter, so I will be bold in saying that this suit will fail miserably. There is practically no court that has held that there is a right to privacy of this kind. In fact, there are several federal courts that have held that there is no right of privacy in this kind of setting, One of which I litigated in Pennsylvania.

Reading the full article, this school has a history of according special privileges for anyone that claims to be the opposite sex. The put another trans girl in a cabin with real girls, and let a trans man supervise boys taking showers. It’s baffling to me that the trans community is cheered on for repeated abuses like this.
Yes. That’s the issue. There could be other numerous reasons why a student might feel uncomfortable sleeping in the same room with someone. If those reasons are identified beforehand, they can be addressed.
