Protesters who went inside the Capitol during the riot on Jan. 6, 2021, can be charged and convicted of disorderly conduct, a federal court ruled Friday, even if they did not engage in particularly disruptive behavior.
Logical and commonsense ruling.
If your in there with the mob, you are part and parcel of the mob. Your passive behavior while trespassing is rightfully no defense to trespassing and disorderly conduct charges.

The defendant’s misdemeanor convictions and jail sentence was upheld.

Actually, don’t trespass.
If you want to visit the Capitol, there are prescribed visiting hours and rules.
Obey them and you won’t end up in court.

I agree with that.
They shouldn’t have been in there. Mob mentality can sweep people along, but it’s still not an excuse for trespassing.
Should be a small fine and a few days in jail right?
Bet my boots the radical partisans presiding will issue much much bigger penalties!
p.s. This ruling come from a DC court?
