Once again Judge Napolitano misrepresents the truth on Newsmax

Judge Napolitano alleged today, 3/26/2025, while on Newsmax, that President Trump has no authority to not allow the funding of NPR (National Public Radio).

But Napolitano ignores that part of our Constitution which gives a specification of particulars for which Congress may lawfully tax and spend, and also ignores the part of our Constitution requiring Trump to uphold the Constitution which grants no authority to Congress to tax, spend and finance a government created new service which has proven to be an institution used as a tool for propaganda.

So, let us look at the reasoning which such power was never delegated to Congress:

"The framers of the Constitution guarded so much against a possibility of such partial preferences as might be given, if Congress had the right to grant them, that, even to encourage learning and useful arts, the granting of patents is the extent of their power. And surely nothing could be less dangerous to the sovereignty or interest of the individual States than the encouragement which might be given to ingenious inventors or promoters of valuable inventions in the arts and sciences. The encouragement which the General Government might give to the fine arts, to commerce, to manufactures, and agriculture, might, if judiciously applied, redound to the honor of Congress, and the splendor, magnificence, and real advantage of the United States; but the wise framers of our Constitution saw that, if Congress had the power of exerting what has been called a royal munificence for these purposes, Congress might, like many royal benefactors, misplace their munificence; might elevate sycophants, and be inattentive to men unfriendly to the views of Government; might reward the ingenuity of the citizens of one State, and neglect a much greater genius of another. A citizen of a powerful State it might be said, was attended to, whilst that of one of less weight in the Federal scale was totally neglected. It is not sufficient, to remove these objections, to say, as some gentlemen have said, that Congress in incapable of partiality or absurdities, and that they are as far from committing them as my colleagues or myself. I tell them the Constitution was formed on a supposition of human frailty, and to restrain abuses of mistaken powers.” Annals of Congress Feb 7th,1792 Representative Page

So why is our federal government allowed to get away with such misappropriations of federal revenue? Because up till now, spineless Presidents have closed their eyes to such misappropriations of federal revenue, and media personalities like Judge Napolitano, who is a favorite guest on Newsmax, are not questioned and made to substantiate their outrageous opinions when presented as fact.

I think NPR is great and I have no issues with federal funding but if it goes away which I expect it will, NPR will figure out a way to survive.

Democrats have bigger and more important battles to fight

correct. congress controls the pursestrings of the government.

If you like NPR…cut the check to hear them. If there’s not enough listeners to financially support this news outlet…say bye. It is NOT right for American citizens to cut the check for any news source.

Congress is not authorized to tax and spend on objects not authorized by our Constitution, and our President is obligated to be obedient to our Constitution which lists the objects for which Congress may lawfully tax and spend on.

Misappropriation of federal revenue is a criminal offense.

congress do it all the time.

they are incharge of the nations purse strings.

Congress is authorized to tax and spend on the objects authorized beneath Article 1, Section 8, Clause 1. If Congress doesn’t like Trump defunding NPR, take him to Court for not being willing to engage in a misappropriation of federal revenue.

congress control the purse. not the executive.

read the constitution for editification.

And the Executive Branch is charged with making certain the terms of the Constitution are faithfully executed.

Except when Democrats win a presidential election. Then they can pull back congressionally approved funding to build a wall because they don’t like it.

I do support NPR financially.

Like I said doesnt bother me if they lose funding, NPR will figure out a way to continue. Some of the smaller local stations will probably go under which is sad because the local community content they carry is excellent but the syndicated shows do tend to eclipse that.

NPR does a far better job covering global news that does not impact the US than any of the news networks or US news cable outlets.

I stand by my assertion that the majority of people who bitch and moan about NPR being a far left radical news outlet have never listened to NPR for any lengtg of time or listened to cherry picked short sound bites from their favorite conservative pundits.

I agree.

And when they do, it will be as it should be.

If they do, without tax payer money, that’s how it’s done and I support that.

NPR is pretty apolitical in my personal experience.

I agree. They have a broad spectrum of political guests and attempt to strip away the spin.

They were not shills for the Biden administration in the same way as Fox is for Trump, and regularly aired segments questioning Biden. For example the withdrawal from Afghanistan and Bidens failure to move forward with one of his key planks on voting rights.

I know the Hunter Biden laptop will be bought up and NPRs CEO admitted to congress that that was a mistake and did not try to explain it away. The CEO acknowledged it hurt NPR as it fueled the claims of bias.

The media tracker Allsides rates NPR as left leaning not left wing propaganda.

I stand by my opinion that the majority of NPR critics have never really listened to it. Most fans of talk radio will find it boring because they do not try to create outrage. No shock jocks on NPR :grinning:.

Only 1% of NPRs budget comes from Federal funding which while that money would be a loss I do not think it would be the death knell for NPR.

Now here’s where factual evidence shows a strong left wing, political bias and thus…not neutral. All federal funds should be immediately halted.

Yes I mentioned that. Why did you omit my comment about that and how the CEO admitted to ignore the laptop story was wrong?

Not sure what else can be said. She took accountability and said it was an error.

It wasn’t intentional. I just took the first sentence of each and posted what is currently happening where they are being questioned and answers given regarding this discussion. That said, when the words “far right” are used 162 times and “far left” just a few…it eliminates any and all questions regarding their political slant and what party it is they are selling.

They always take accountability after the damage is done and accountability means no punishment or undesirable consequences.

Precisely. “I already APOLOGIZED. Now move on. There’s nothing to see here…”
