There is,however, something in the statute that has the requirement that the lie is to influence a person giving testimony to an official proceeding. Lying to the NYTs is not the same thing as lying to an official proceeding…which Trump never tried to influence McGahn to do.

According to McGahns testimony Trump asked him why McGahn told the SCO about what Trump asked McGahn to do.

If Trump wasn’t expecting him to lie, why did he act shocked that McGahn told the truth?

Expecting someone to lie, if that is what he was expecting, is not a crime.
Why on earth would he expect McGahn to lie to the special counsel when he wouldn’t even lie to the NYTs?
