Getting back to the subject of the thread, the fact is, Justice Sotomayor gave the finger to New Yorkers and spat upon that part of our constitution guaranteeing their right to petition their government for a redress of grievances and be heard. And, she also ignores the irrefutable fact that the NYC COVID vaccine mandate impinges upon a fundamental right!
Keep in mind an act which “impinges upon a fundamental right explicitly or implicitly secured by the Constitution is presumptively unconstitutional.” See: Harris v. McRae United States Supreme Court (1980) Also see City of Mobile v. Bolden, 466 U.S. 55, 76, 100 S.Ct. 1490, 64 L.Ed.2d 47 (1980)
The NYC vaccine mandate leaves no option for the teachers as is given to other city employees, i.e., a periodic testing for COVID, and not giving this option to the teachers violates the equal protection of law which is fundamental to our system of government and obligates the court to hear the people and resolve the issue within the mandates of our constitutional system.
Justice Sotomayor has willfully spat upon the rights of NYC’s teachers.

Yup! And I think their union lawyers sold them out by presenting a very weak case. They never demanded a fundamental right was being trampled upon requiring the protections of “strict scrutiny” to kick in.

If they have a contract with the state, I don’t see how the state can legally force them to do anything outside of the contract, and before a new contract without some sort of MOA. That would require union support and a vote.

From what I have read, that is basically what the Union lawyers argued and was ignored by the court. What they did not argue was the COVID vaccine mandate impinged upon a fundamental right of the teachers, which in turn triggers the protections of “strict scrutiny”, and if applied, would, at the very least, have require the government to give the teachers the same option [periodic testing] as other government employees.
