Dont get me wrong…if the Governor of Oregon wants the guard in portland than he should request it. Not have it forced. Just my opinion…

Cooling off periods are about letting both sides reconsider. I fully expect the protest element to celebrate and escalate, all in front of cameras. Then instead of 200 National Guard, it will be 400 US Marshals and other federal LEOs. And anyone throwing anything at them, or damaging federal property, or injuring a federal officer, or attempting to stop an arrest, will be taken into custody on a federal charge, en mass. And they will be evacuated, probably to the interior of a Military Reservation, for detention and arraignmennt before a Federal Magistrate. This won’t stop him from flooding the zone, it will just cause him to use LEOs instead of the National Guard. And that will lead to many, many arrests.

Exactly, is that not how it is supposed to legally happen? Governor orders the Guard and if Federal assistance is needed, request it.

True, but, under what authority does a President have to federalize Guard units bypassing the State Governor?

Insurrection. What is happening in Portland is an insurrection (organized resistance against the government or established civil authority, often with the goal of changing it.) against the federal government, being aided and abetted by the local and state government. The organized, equipped, coordinated daily protests are a form of low intensity politics by other means, aimed at neutralizing federal authority and law enforcement activity within Portland specifically and Oregon in general.

It is actually pretty easy in the case of these actions being taken against ICE operations and facilities. Usually riots are about an isolated incident that ignites pent up public resentment. This is different, in that the actions being taken are attempting to disrupt ongoing federal law enforce activities, and targeting federal officers and facilities, in furtherance of the attempted disruption. Thus you have organized unpeaceful resistance against lawful law enforcement operations of the duly elected federal government. The president cites the Insurrection Act and declares the action in the specific jurisdiction as such and orders in what ever force he deems necessary to restore order. I think they are going to wish it was 200 NG instead of several hundred federal LOE officers. The NG would simply be a guard force, not an LEO arm. They would be deployed immediately around the Federal Buildings, freeing up federal LOEs from having to perform facility security. Now they will get a flood of LEOs that aren’t going to be restricted to physical security duties.
