trump believes nothing of the sort. what he believes is the supreme court was so far out in lala land with their daca decision it allows the executive to do things they shouldn’t be able to. he’s right. the 9th circuit was correctly over ruled. congress, in its wisdom, gave the president the power to divert the funds.

It doesn’t matter if Congress passed a law giving the President the power of the purse. That law would clearly be unconstitutional. Back in 1996, Congress passed the Line Item Veto Act, which was signed by President Clinton that gave him the line item veto. But the Supreme Court ruled that law unconstitutional in Clinton v. New York City back in 1998. That Supreme Court ruling affirmed that the power of the purse exclusively belongs to Congress The Constitution is the Supreme law of the land.

The Supreme Court hasn’t overruled the 9th Circuit Court of Appeals. What they did is issued a stay in the 9th Circuit Court of Appeals ruling. The stay is still in effect by a 5 to 4 vote. Link

Just a week ago, an appeals court correctly reversed a lower court’s dismissal of the House’s case against the President. The House has the right to sue the President over the power of the purse, and they now can go forward with their lawsuit against Trump.

The appeals court said Friday that the Trump administration “cut the House out of its constitutionally indispensable legislative role” of handling appropriations.

“To put it simply, the Appropriations Clause requires two keys to unlock the Treasury, and the House holds one of those keys. The executive branch has, in a word, snatched the House’s key out of its hands. That is the injury over which the House is suing,” the three-judge panel on the D.C. Circuit wrote.

The judges consisted of one Reagan appointee and two Obama appointees.

when the congress gives the executive the authority, he has it, thats what laws do.

and the SCOTUS is above the appelate courts and already decided this. not to mention one house of congress has no standing, that is well established in law. The entire congress gave the authority and 1/2 of it can’t take it away.
