Bail has only one Constitutional justification - to coerce those acused of crimes into showing up for court.
That is not how bail is used today, for the most part - hence the need for bail reform, and organizations such as MFF.
It is unconstitutional to use bail or remand to punish.

If you were served a subpoena to turn over your computer that had classified information on it, and you destroyed it instead, you know damn well YOU would go to jail. You are of no importance to the powers that be. Hillary is.
