No he didn’t, that’s BS.

Even if he had by retreating he regains his right of self defense.

Brandishing a firearm is not showing it. They may have seen it on his hip.

He didn’t start the fight.

He is not the one who instantiated the use of force.

Witnesses lie.

Where is the supporting video?

I’m not getting heated bud, I just like debate. It’s certainly not my intent to make anyone mad. I think your link shows the exact opposite of what you’re claiming. He communicated his intent clearly by running away IMO.

Purpose of pepper spray.

It’s a great comparison.

And you’e wrong.

By quitting the fight or attempting to do so you regain you self defense rights.

Can I not argue that unpeaceably assembling to knock down a statue (unlawful act) started the fight?

True, I don’t know if he showed it or it was just observed. The voices in the videos I’ve seen claim “he has a weapon”…

I disagree. You’re saying the woman did with her boxing technique, I disagree. If it does rise to assault, I do think a judge would say his response was disproportionate. You can see in one of the first videos posted above she definitely went down on pavement… she was not “rolled” on the pavement. lol.

Sure they do. Here’s the simple fact. Witnesses said he had a gun. Turns out he did… he shot a guy with it. Are you implying he didn’t have a gun? Im not sure what you’re arguing here?

Disagree all you want, the law is plain.

She committed a misdemeanor assault and he was therefore entitled to use non deadly force to stop her.

Any time you put your hands on another person it is assault and possibly battery

No.

Baca isn’t the statue.

Thanks for the clarification.

As for my link, I think it supports exactly what Im saying. Ironic, isn’t it? Language that should have the least ambiguity in it reads in a manner where we both think it supports our position :man_shrugging:

Does he not have the ability to detain another citizen under New Mexico law?

Possibly.

Did he try to detain anyone?

You continue making things up.

You can use force in NM to prevent a crime.

:man_shrugging: IMO, no. Tearing down a statue is not an assault and it’s not the perpetrators personal property. Be an interesting defense though, just don’t think it would fly.

I don’t know. It appears he was attempting to stop their unlawful felonious activity.
