Actually, it is done by candidate. I used parties in the OP, but the transfer votes are done to individual candidates.
the constitution guarantees a republican form of government, not party preferences. one vote one person, not one vote and several alternate votes.

What is the specific ballet access law adopted in Main which you are referring to?
JWK
Has it been challenged on republican-form-of-government grounds.
How exactly would that challenge look? Like on what grounds?
like in the constitution.
the constitution guarantees to each state a republican form of government. the federal government is responsible for enforcing it. a republican form of government requires direct election of representatives, not amorphous party votes. one person, one vote. not one person one vote, and then three alternate votes in case your first vote doesn’t win.
The Guarantee Clause:
The United States shall guarantee to every State in this Union a Republican Form of Government
Ben Natuf’s claim about us voting for people instead of parties made me think it could apply, but Safiel reminded me that rank voting would still involve voting for people.
it violates the one person one vote sacred charge.
the part where if your vote doesn’t produce a winner they throw it out and take your second vote

I can see that. But, petitions also work a little like that.
petitions are not government. one person one vote.
i can see why leftists like the idea, every leftist whacko who votes green or cpusa would have their 2nd choice a democrat, and probably 1/2 the libertarians and a lot of anarchist trash.
The courts have found the question of exactly what constitutes a “republican government” as mostly non-justiciable under the political question doctrine.
It’s no different from run-off elections.
How is it fundamentally different from a runoff election?
used to, latest case changed it to case by case basis. the courts can’t resist taking more power
a run off election is the result of a jungle primary. you go vote for one candidate. if none win, you go vote for one candidate in the general.
