Very good … justice is served. And lesson learned … Assault a cop and wind up in court and have to pay good money to a lawyer to get you off. I bet he never assaults another cop again. :wink:

He lost his job which is fair enough. It should have stopped there. The charges they went for ridiculous and the border agents evidence was just as stupid.

Well hopefully the lesson is learned: don’t charge when emotional, and don’t overcharge.

I bet that if she had just charged the misdemeanor to begin with and, didn’t overcharge with an accompanying press conference, that she would have got him

Yes, this prosecutor could not even get a guilty verdict on a misdemeanor.

Can’t even toss a free sandwich to an officer without getting charged these days. Sheesh.

I think what killed it is the ICE agent said onions and mustards flew all over him, that he could feel the sandwich hit through the ballistic vest he was wearing. The Defense just showed the jury the video. It was a wrapped Subway sandwich and when it hit the ground it was still wrapped tight. I imagine a few jurors were wondering why the hell they were even there. They asked the Judge to define what assault was, and if it involved bodily harm. The US Attorney was fighting to keep the definition of assault as vague as possible but, in the end, the jury didn’t see what harm was done.

Not guilty of assault with a foot-long weapon.

I was paying attention to that trial. The jury reconvened this morning and I was surprised they were in talks so long that they got a lunch break. Now I think they just milked it long enough to get a free lunch.
