Is this Lockdown Constitutional?

That is a federal law – has the the Federal Government order businesses in all states shut down?

Doesn’t give the states the right to violate the constition however.

Good thing they don’t then. Point out the violation, there is none

I don’t think so, are you suggesting that proves what was done in this case is Constitutional? Because if you are:

  1. You are looking in the wrong place. The central government did not institute the lock down.
  2. You aren’t reading what it says.
  3. The way it was done is problematic.

Whether or not what they did is Constitutional remains to be seen. Mostly because what they did has never been done before.

Of course it has. 1918.

Point out the potential conflict then if you can

States that are shutting down churches, and arresting those who run services:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof

Are prohibiting the free exercise of. Unconstitutional

or abridging the freedom of speech, or the right of the people peaceably to assemble,

Following Monday’s protest at the state Capitol where demonstrators defied Gov. Gavin Newsom’s orders banning large gatherings, the California Highway Patrol says it will no longer issue permits for events at any state properties, including the Capitol.

After a news conference by LGBTQ activists critical of Mount Sinai Hospital’s relationship with a religious organization during the coronavirus pandemic, the city’s police commissioner and the mayor said “protests” would not be tolerated.

Unconstitutional in not giving ANY permits for events such as rallies. And that any protests will be broken up. Violation of the constitution.

As allowed under the 10th

Attention to detail.

What is the main difference between then and now?

They are still free to exercise that right

That’s not how it works. The 1st is incorporated.

You know up until 1878 it was constitutional to hang a person or burn them alive as a death penalty right?

When was the constituton signed again? How long did it take to find that unconstitutional?

Things can be found unconstitional . . . . like shutting down nearly every damn aspect of the economy.

Remains to be seen.

And until that point they remain constitutional

When was the last time this law was invoked? Say the last 10 to 20 years when we have become a country were every law and action is challenged?

Hanging still is.

Show where that right has been denied

Well in that case literally anything can be arbitrarily declared Unconstitutional on a whim, can’t it? Doesn’t exactly make it so, now does it?
