I’m 1997, I doubt I would have been taken seriously.
I knew my place.
Was the President Black?
FYI, In 1997, I doubt I would have been taken seriously either.

No it’s not an “elitist” concept at all.
It’s a difficult concept to define and talk about, but not “elitist”.
Again I sense you are having a visceral reaction because of the innate belief every one of us has that our success (or lack of it) is down completely to factors under our control.
No, not just “in theory.”
Yes, seriously.
Why wasn’t it an option? If what you’re saying is true, you definitely had a case.

My guess is they didn’t come right out and tell him that.
Like when I got let go at my last job before this one…they swore they didn’t let go of anyone based on their age.
But the two people they let go at my level were both 50+ years old, and the people who they were up against (there were four people for two slots) were in their 30s.
There was just enough math and stats in the documents they were required to release by law to cover their tracks well.

True story.
The fact is I didn’t really disagree with the president of the company. He was being open and honest and I understood his position. The company did a lot of work with government agencies. It was matter of optics.
I knew I had a case.

He came out and told me exactly that.

You should have taped him lol.
They don’t usually do that.
I can see it would devolve into a he said he said.

I actually had a good relationship with him and believe it or not, I liked him. I appreciated his honesty.
And since I have worked with him from the contractor side. I’m bitter about the situation, not angry with him.
But the situation, as you describe it, is his fault. He wasn’t following the law - he broke the law that you’re so mad about.

Yeah, you’re right. I was mad at the law caused him to discriminate against me.

I sooooo love all of these “I am a hiring manager”, “I was a GM”, etc…yet have no clue how it really is. I don’t give a damn what the law says, companies know that someone won’t file a lawsuit over this because the cost in time, stress, etc just isn’t worth it.

The law didn’t “cause” him to discriminate against you. In fact, the law explicitly makes what he did illegal.
Maybe his misinterpretation of the law cause him to discriminate against you.
But there is absolutely nothing in the law that allows that type of discrimination.

I represent employees in their discrimination claims against their employers for a living.
Please, tell me more about “how it really is.”
I know exactly how it is. It’s not the law that’s the issue.
Maybe, but then the same can also be true of every other protected class. Not just white males…
There are many reasons why someone won’t report sexual assault or discrimination. But that has nothing to do with the law. The law is clear.
Sure you do, let me guess…you NEVER lose either

Of course we lose some cases, that’s how it goes. You can only work with the facts you have.
What about this is so difficult for you to believe?
That almost every time the same posters are “experts” in seemingly every topic discussed. I HIGHLY doubt that is true. Excuse me if I have a hard time believing ANYONE on a forum is a SME on so many things. You claim to be a lawyer, why should someone believe you?
PnG has claimed to be (in this thread) an IT Programmer, Director, and now HR Director, lets just say I have doubts anyone is who they say they are. Afterall, it cannot be verified, hell I could claim to be CEO, you have no way to disprove it.
