They don’t have to explain anything. Prosecutorial discretion is an executive thing which courts have no control over. Once the government moves to dismiss, the judges job is ministerial. The ONLY function other than ministerial is to ensure the move is not in an attempt to harrass the defendant. You’d like them to further explain because you think you’ll find some dirt there.

The initial investigation was in the process of being closed because there was no evidence Flynn did anything unlawful, so the thing to do is keep it open to investigate a thing you already know is not unlawful? okay.
Have you been living under a rock? What in the hell do you think their argument to dismiss was? “Even IF Flynn did lie, the lie was not material”. That’s not from me, its from the DoJ. If any lie he may have told is not material, then it is not illegal and no law was broken. That’s why they say they can’t convict him, because he committed no crime to convict him of.
As I’ve stated numerous times now. They also argued that his lies were material, and Judge Sullivan ruled on this. It is against the law to lie to the FBI. They have not claimed that “no law was broken” in any court filing. I was asking if you know of any other statement where they said no law was broken. That claim is false.

The claim is NOT false. You refusing to acknowledge what they say now in favor of what they said before does not make one damn thing false. Lying to the FBI is NOT illegal unless the lie is material. The DoJ has admitted that nothing Flynn told investigators is material, therefor it cannot be a crime. I don’t give a damn what Sullivan ruled, the appellate court just told him to stop grandstanding and get on with dismissing. The order was quite scathing in its rebuke.
Did you read the order. Your posts lead me to believe that you are relying on headlines.
It seems apparent that one of us has been relying on the court documents of the case while the other has relied on opinions that media has provided.
