Per the Constitution, the Vice President is an officer in the legislative branch as President of the Senate, and in that capacity, they are empowered to cast a tie-breaking vote. There is no provision in the Constitution for a member of the Judiciary to cast votes in the Senate, not even the Chief Justice.
