You guys are looking at this all wrong. It isn’t like a criminal trial, he was already impeached. If anything it is more like the sentencing phase.

The Senate can’t unimpeach him.

Impeachment is closer to being indicted by a grand jury than an actual trial, and the impeachment trial is closer to a real trial than a sentencing hearing.

And a sentencing hearing doesn’t take place until one is found guilty.
