The International Criminal Court is seeking arrest warrants for Hamas leader in Gaza Yahya Sinwar and Israeli Prime Minister Benjamin Netanyahu on charges of war crimes and crimes against humanity over the October 7 attacks on Israel and the subsequent war in Gaza, the court’s prosecutor Karim Khan told CNN’s Christiane Amanpour in an exclusive interview on Monday.
It is unlikely that Israeli or Hamas leaders will be arrested as a result of an ICC warrant since neither Israel nor Hamas are parties to the treaty that established the court. The immediate issue would be that officials sought in any warrants could be arrested if they go to countries that enforce the warrant. At this point, most of Europe, Latin America, and Africa have ratified the treaty that established the ICC.
The US has applauded ICC actions in the past when they have supported policies from Washington, but the US and Israel have not ratified the treaty that created the court. Congress has even pre-authorized the use of force the free any Americans under arrest at the ICC under the so-called Invade-the-Hague statute.
Is the ICC effectively finished as a working body the US imposes sanctions or directs military action to force the ICC to withdraw arrest warrants against Israelis?
Is that a good thing?
Or should the US support the ICC even when it goes against State Department policy?
The ICC is unique in one way. It is the only organization I know of that has arrest warrants out for two people who control armies and likely nuclear weapons.
I would not volunteer to serve those warrants.
124 nations have signed up to recognize the ICC. The US, Israel and Palestine have not; however Palestine has recognized the jurdistiction of the ICC so it will be interesting to see their reaction.
Oh I totally get the hypocrisy of SA bringing this action. Though to be fair not really read a lot on this as its really just all noise and does nothing to help the situation.

Interesting a court tht has its own prosecutor.
So much for separation of powers.
Maybe they should write their own laws to.
I mean if we roll the executive and judicial powers into one why not the legislative too.
One person or one body with the power to write the laws, execute the laws and adjudicate them. . . . What could possibly go wrong? Who could possibly object to that?
The ICC just declared themselves to be a joke. What kind of an evil is present in a culture, to do what Hamas did? It must be eradicated off of the face of this planet along with anyone, everyone and anything that would support this absolute evil.
