If the State was in the business of producing oil, you would be right. But they aren’t, so they sell leases for the right to drill for oil to the people who do have the means to produce it, and they take a healthy share of the produced oil in the form of royalties. It’s no different than if you owned a forest of Douglas Fir, but had no ability to cut and transport the trees to market, so you contract with a logging company to do it for you and they pay you some agreed to price for each tree. But that does not make you a wood producer.
